Biographical note

This case, Wilson v. The Great Western Railway Company, centred around an action brought on behalf of Mr William Douglas, proprietor of The School, Malvern Link. Douglas claimed that the railway company was in breach of an agreement made in the 1860s by its predecessor company with the Great Malvern Hotel Company, (whose property, the Malvern Link Hotel, had stood on the site of Douglas' school), to supply water fit for drinking purposes, via the springs in a tunnel owned by the railway company. Following a complaint to the UDC, and recent cases of typhoid at the school, Hillyard inspected the Malvern Tunnel and found there to be an open-jointed pipe running under the sleepers and in no way protected against pollution. The judge found that there was no breach of covenant by the railway company and the action failed.
