Description

"A copy of the Will of the late Sir H S Wellcome, and memorandum for the guidance of his Trustees, with extracts from amending Orders of the Court of Appeal, the High Court, Charity Commissioners' Schemes, and Regulations made thereunder". A printed booklet (Cameron Markby, Moor House, London Wall, EC2Y 5HE). Without publication date, but dating can be inferred from the amending Orders which are printed as appendices (most recent date of reference, 1985), and the front cover is annotated "Current at May 1989".

Two brief letters (both November 1976) from Slaughter and May to A J Shepperd (who became Charman of The Wellcome Foundation in 1977) referring to a forthcoming meeting between them, and enclosing "Instructions to Counsel on the questions you have raised in connection with Sir Henry Wellcome's Will". The "Instructions" (12 November, 1976) are also present in the file, in which several questions are clarified, e.g. "If it should become in the interests of the Wellcome Foundation Ltd that its shares should be more widely spread (either to facilitate the raising of new equity capital or for other reasons) would there be a reasonable chance of the Court accepting that the Trustees should be entitled to sell any existing shares held by them?" This question, along with others, is to be discussed with Counsel.

Also, a typescript fragment ("p. 16", plus an additional half-sheet) from an unidentified document referring to "an Order of Mr Justice Upjohn dated 10th December, 1956"). The Order in question can be found printed in the Appendix to the Will (pp. 35-37) noted above; it concerns "Augmented Investment Powers".
