Description

Correspondence concerning TRC consideration of opposition to CIBA (India) patent application 31572 ("Culture media for mould fungi and process for the manufacture of antibacterial substances"), a copy of which is included. Other Indian patent applications are referred to.

A watching brief was decided upon as the best course of action: "On the whole it seems to me that we should watch these applications and consider the possibility of entering opposition when they are accepted, but that quite likely we shall not be able to oppose some or all of the applications. Nevertheless, even if the patents are granted we may feel able to ignore them and if attacked by patentees at a later date be able to defend ourselves successfully by pleas of prior commercial user, which it is not possible to raise in the more restricted opposition proceedings."
