Having before us the implied sense and POSITIVE injunctions of the law, it cannot be diffi- cult to conclude in what manner prifons ought to be conftru£ted, to anfwer the purpofes of their inftitution. Fir/1. A prifon mud be a place of safe custody, or it is abfurd to infill on a Sheriff’s refponiibility. But this fafety Ihould (as before obferved) be attained by the manner of its conllruclion, the regulations of its police, and the attention of its officers, and not by means unwarranted by law. Next to the fecurity, the healthiness of pri- fons is affuredly the moll important obje£l of atten- tion. Gaol-fever is found to arife from the corrupted air of crowded wards, and vapid cells; and from filthi- nefs of perfon and apartments. The latter is in- tended to be prevented by the acl, 14 G. II. before mentioned: Succefs in this point,however,will depend more on regulation, than conftru&ion ; but mofl on the difpofition of the gaoler, notwithstanding his attention is flrongly enforced under the faid acl; the noifomc effedls of crowded wards, of vapid cells or dormitories, are entirely within the power of redrefs, by the man- ner of conftru&ion.
